The photograph is in the possession of the Carrington family. It is the only photographic print of the image known to them. We believe it was taken in Hong Kong when he was Chief Justice, although it is possible, but much less likely, that he had it taken in England. It was first published on the frontispiece of Volume 2 of James William Norton-Kyshe's History of the Laws and Courts of Hongkong (London and Hong Kong,1898). The frontispiece photo, copied from the frontispiece but not from an original silverprint, was used several times afterward by newspapers.

There is no photographer's label or signature on the print we have, nor any notice of place, nor any mention of copyright. Neither is a source given in Norton-Kyshe,1898.
This photograph may be considered to be in the Public Domain. There is no information on the print or in family records that gives the name of the photographer or his place of business. We have also checked many portraits of that period visible online, including many at the National Portrait Gallery, and do not find any with the same studio background. If the photo were taken in Hong Kong, as we believe it was, it would be considered free of copyright today because where the photographer is unknown, the presumed copyright expires at the end of the 50th year after first publication, hence January 1, 1949. (Note that if we are wrong, and the photograph were taken in England, it would also be free of a presumed copyright; where the author is unknown, the presumed copyright expires at the end of the 70th year after first publication, hence January 1, 1969.) In the United States, this image is also in the Public Domain, for reasons given under Licensing below.
