Certainly not "de minimis"; the whole of the poster of Xi was clearly visible in a prominent position in the foreground. • Keep The argument to delete is preposterous, as there is freedom of panorama in HK. There is no copyright violation, as reasonable use in parodies is a fair-dealing exception under Hong Kong legislation passed this year: Copyright (Amendment) Bill 2014. This is not a criminal act, so mens rea doesn't really come into it. And even copyrighted items are involved, their appearance is well in line with de minimis provisions. HK is now so full of advertising billboards that any images of the city out of doors would seriously get into the way of copyright if we apply the reason for deleting; banners, cutouts images of XJP inspired by that original are everywhere. Freedom of panorama does not apply to posters; and "fair use" is not the issue on here. The image file does not actually have free content because from that image anyone can reproduce the clear photo of Xi and infringe the copyright of the original photo. • Weak keep - Thank goodness the dao (道) is not used in Hong Kong. Otherwise, I would have lean toward "unfree". Using copyright as an excuse to pledge allegiance to Xi Jinping perverts the intentions of copyright. Why not use "personality rights" instead? Oh, wait. The authors mock Xi Jinping, yet a derivative of such display is not a copyright violation because the authors intentionally display it publically without commercial intent. If intent was commercial, and the photo was uploaded, the protesters' copyright would have been violated. However, their intent was publicity without charge, so the uploader may have a right to upload whatever the photo shows as long as there are other banners in the same photo. Look, you're understandably confused. This is not a two-dimensional display but an entire panorama of an 8-lane expressway that has been occupied. However, most of the other objects in the picture are infrastructure which has been given various adornments, many of which are posters which have a low threshold of originality, so copyright cannot be claimed. So while the rule you state may apply if this was a picture of the poster/banner alone, it does not apply to the image itself.
