The ImageChef ToS, inter alia, permit commercial use only by subscribers and only during the term of there subscription. Therefore the uploader cannot have the rights to freely license the work. All photos by Forest & Kim Starr, members of the US Geological Survey are in the public domain, as was indicated on their website. This photo has been linked to the website from which it has been taken. I can't help that this website suddenly has become a 404. I remember uploading quite a lot of photos taken by Forest & Kim Starr. In 2004 license review didn't exist. Nowadays I use the template license review for such cases, in order to avoid later discussions like this one. Update: look at this website [1] and you'll see CC-attribution license for their photos.
