I think somehow the case needs to be made for what distinguishes this archive from the many thousands that now exist online for most major authors. PS: like you, I am an inclusionist. Formulafiftypoet 17:47, 19 July 2007 (UTC)[reply]

As the articel notes, the site asserts a copyright on the contents. But given that darwin died more than 120 years ago, and most of he works were published during his lifetime, it is hard for me to see how any of this can be copyrighted under either US or UK copyright law. Can anyone find a reliable source that discusses such claims and how valid or othrwise they might be? My personal view, while not uneducated, is non-expert, and would be OR even if I waere an IP lawyer. DES ^(talk) 20:00, 19 July 2007 (UTC)[reply]

It probably wouldn't be an open and shut case if it were taken to court. But see e.g. Commons:Commons:Deletion requests/Images from Darwin Online, where it was decided the images are not to be treated as public domain. Richard001 (talk) 21:17, 5 February 2008 (UTC)[reply]
