You seem to having some difficulties complying with Wikipedia's polices on using copyrighted material. You were notified on November 19th that an editor had detected that the article text was copied from another website. Policy requires only seven days before copyright infringing material can be deleted, so you were actually given considerably more time than usual. Please understand that we do this in order to protect the copyrights of authors who do not wish their work submitted to Wikipedia, and do not mean to inconvenience those who do.

On Talk:Langbar International, you were advised twice of the proper procedure for releasing copyrighted material but you don't appear to have followed those instructions. Again, in order to accept into Wikipedia content which is published on another website, we usually require a clear statement from the author of the content that the content is being licensed under the terms of the GNU Free Documentation License (GFDL) (see http://www.gnu.org/copyleft/fdl.html, or GNU_Free_Documentation_License). This statement must come from an email address that we can clearly recognize as being from the operator of the website, or be in reply to a message sent to the operator of the website. This email should be sent to [email protected]. If you did send an email confirming your release of the text, please let me know what email address you sent it from and I will be happy to look up the request for you.

The article can be easily undeleted as soon as confirmation is verified. By the way, this also applies for the images you are uploading and claiming to own the copyright to -- you may use the same procedure to release them under a free license and have them undeleted as well. You may also want to take a stroll through Wikipedia's policies to avoid running afoul of any further guidelines. For instance, threatening Wikipedia/other editors with the media is poor form and further behavior along those lines may lead to your account being sanctioned. Editors here will be happy to help you learn your way around, no strings attached.

Unfortunately since anyone can edit the policies too, they become very bloated over time and can be difficult to navigate. To sum it up, the idea is to collaboratively write an encyclopedia -- the most important points are: always work with others

point of view that doesn't include bias or promotion. Also, Wikipedia:Five pillars

gives a good overview of the policies without all the mud :)

Hi Nigel, I imagine you have put a lot of effort in linking and formatting the reference, so I want to apologize for having to delete it.

The problem is that R. Laver writes about the details of how Bougainville transferred the colony, but he doesn't argue that "the title ceded to the Spanish by France in 1767 reverted when the Spanish breached the agreement to maintain a colony at Port Louis to prevent the British gaining title". That is what we need a reliable, secondary source for: the "revertion" of the ceded title.

I see that there may be something into it, but (and this is a BIG but) here in Wikipedia we have absolutely forbidden to draw conclusions on our own. That's called "original research" around here, and that's what I mean when I say

reliable source

that says "hey, this is a fundamental breach of contract!". We can not conclude that on our own, not here on Wikipedia.

I note that in your reply you say "So few historians are for that matter, but I have come across one". Who is he? Could he be cited as a source for this idea?

Hi Langus Thanks for replying. The lawyer/historian is Roger Lorton LLB(Hon) M.Phil and he is an expert on the Falkland Islands history too. He provided me with a copy of Bougainville's transfer agreement. The (original) research I've carried out on this claim suggests that Bougainville carried out the negotiations in Madrid. However, he was ordered to do this by Choiseul. Bougainville had just returned from his second trip to the Port Louis colony. He was full of good news that the colony was developing. They'd collected a lot of timber from Tierra Del Fuego and new buildings/homes were being constructed. He reported to King Louis XV and was told that a third supply trip would be made, but not to be commanded by Bougainville. It appears that the transfer of the colony had already been agreed at a diplomatic level and this will be in the correspondence between Choiseul and the French ambassador in Spain, Marquis d'Ossun.

Bougainville himself wrote (in his account of his circumnavigation which can be found here http://ia600706.us.archive.org/31/items/VoyageAroundTheWorldByLewisDeBougainvilleIn1766-9/Bougainville_Voyage_Eng_Transcr_JFF.pdf ) the following:

IN February 1764, France began to make a settlement on the Isles Malouines. Spain reclaimed these, isles as belonging to the continent of South America and her right to them having been acknowledged by the king, I received, orders to deliver our settlement to the Spaniards, and to proceed to the East Indies by crossing the South Seas between the Tropics.

So Bougainville says that the French King Louis XV had acknowledged Spain's rights to the territory. As King Louis had already carried out the formality of receiving the sovereignty from Bougainville in 1765 in Paris and this had been formally announced (to other ambassadors), there would have to be a treaty ceding the title from French ownership to Spain's.

What I am trying to locate is the diplomatic correspondence. This will definitely lay out the terms of the state transfer agreement. There are collections of these in the French archives and I've located the identity of the books which will have copies, but not been able to get hold of one yet. British Library will have one. The copyright issues were initially because I did not provide a license for the picture I owned and uploaded to the website. A later copyright matter referred to material which was removed from the article.
