After the Obergefell decision

I believe that this article is incorrect. True, same-sex marriage is now legal in every state, but that does not change the situation in some states (possibly Mississippi, Nebraska, Michigan, Ohio, Kentucky, and maybe others) that specifically deny joint adoption and/or second-parent adoption for same-sex couples, married or not. Take a look at HRC's maps regarding adoptions, for example. I suggest a partial reversion to the previous list of state laws that keeps the red "X"s for the states that have laws or court decisions that prohibit same-sex adoptions. Suggestion, rename to Gay & Lesbian adoption

I created this entry by compiling material from other entries. It obviously needs a lot of work, but I hope by segregating the U.S. from the more general entry for

LGBT adoption
we can prevent overwhelming that entry with all the detail we find in the U.S. where adoption is, at least for now, very much a state/local issue.

As the entry evolves, I hop it becomes as much about the social phenomenon of gay adoption as the legal status thereof.

"Professional Assessments"

The citations in this section refer to court cases to determine the "consensus has developed among the medical, psychological, and social welfare communities that children raised by gay and lesbian parents are just as likely to be well-adjusted as those raised by heterosexual parents" thesis. Dubious

The impact of Obergefell on adoption by married same-sex couples varies by jurisdiction. Obergefell did not address adoption or parental rights. If a jurisdiction prohibits adoption by unmarried persons, then presumably a married same-sex couple can adopt in that jurisdiction. If a jurisdiction prohibits adoption by an lgbt person, then Obergefell has no bearing. Obergefell may provide precedent for litigation on lgbt adoption, but it does't address it directly.

Adoption by unmarried lgbt persons should be addressed as a separate matter from adoption by married same-sex couples.

  • I don't think it's dubious to assert that Mississippi is the last state where same-sex couples cannot adopt. Its status as such has been widely noted and reported on in several news sources like USA Today, New York Times, AP, Reuters, and several others.   • The claim of Dubious was a general one of the rather broad claims in the table and article, particularly in previous edits, rather than a specific claim on Mississippi.
