If we included a fair-use picture of Officer Pantaleo, would you defend it on the grounds that it would help readers see he was a human being who had to make a difficult decision? That's essentially the same thing.

How is Pantaleo compared to Garner? Also, the title still has the victim's name, even with "Death of". I know Garner is not the main subject of the article; he can be the subtopic of the article. The article discusses death, investigation, trial, and settlement. Nevertheless, it also describes brief background of the victim in one section. I am reading

The interpretations of NFCC varies. One would say that the image meets all criteria; you said that the image is insignificant to Garner's death. Though pre-death images are used as commemorations, Wikipedia ≠ memorial. Nevertheless, the pre-death image of Garner is as encyclopedic as the current lead image of Garner being arm-choked by the police. If you are discussing significance, if the victim's name is not part of the title, the bio image would not be significant. However, even with "Death of", there is also "Eric Garner". Statistics would say that the amount of readers typing or clicking just "Eric Garner" is very low. Keep - Was going for "weak keep", but the screenshot shows the intentionally offensive content for importance to the article topic.
WP:NOTMEMORIAL would be too weak of a reason to delete the image. This biog. image can be useful in the non-biog. article if the title contains the man's name, even with "Death of". Removing the image would make the readers think that "Eric Garner" is not important part of the subject, his death, even when Garner himself is not "notable" under the Wikipedia definition. WP:NFCI is bolded to emphasize its explicitness: "Pictures of deceased persons, in articles about that person". This picture is not being used in an article about that person since we have no article about Eric Garner per se. Therefore it needs to qualify on other grounds. It does not.

As for "reticence", I thought I was pretty wordy; can you either ask for what you would like to hear more argument on or perhaps choose a different word?
